Terms and Conditions

The Promoter is: Leader Associated Newspapers Pty Ltd, 1-7 Chapel Street, Blackburn VIC 3130. ABN: 34 004 337 446.

Information on how to enter forms part of these Terms and Conditions. Entry into this program constitutes acceptance of these Terms and Conditions. Entry is via the official Leader Local Grants website only at www.leaderlocalgrants.com.au (Website).

The Promoter has developed the Website to work in as many environments as possible with current and recent browsers and in a responsive fashion so as to be as compatible with as many devices as possible. The Promoter’s intention is to make this site as usable as possible. Unfortunately entrants are currently unable to submit an application while using the site on an iOS device.

The Promoter accepts no responsibility for errors in the Website and any unavailability of the Website.

 

1. LEADER LOCAL GRANTS (PROGRAM) 

Leader Local Grants is a community program that provides financial grants to small, not-for-profit projects which are intended to improve local communities where Leader Community Newspapers are distributed (Leader Community Newspapers Distribution Area Suburbs List is included at the end of these Terms and Conditions). Financial grants will be awarded through a process of i) Application ii) Finalist Selection via a Judging Panel and iii) an online voting process.

The Program is open to Victorian residents, 18 years and over as of 12 June, 2017, who reside in the distribution areas of eligible Community Groups operating in a Leader distribution area in Victoria as at 12 June, 2017. For the purpose of this Program an eligible Community Group is a registered and/or verifiable local community organisation in the Leader distribution area that benefits and contributes to the local community for public good and includes (but is not limited to) school, sporting, not-for-profit or charitable activities. It does not include business, professional, political or other groups which the Promoter may determine, at its sole discretion, are involved in the conduct of activities that may offend prevailing community standards. The Promoter at all times and in its sole discretion, may determine the eligibility of a Community Group with regard to (without limitation) the nature of the activities, the structure and any other considerations determined by the Promoter in its sole discretion.

The Program is available for small projects that are not-for-profit in nature and cost a maximum of $5,000 including GST in total (including the Grant amount). Projects can be connected to a business if the business is offering its services in relation to their project at no charge to the user.

Projects must offer a service to a specific local community and must be submitted for the Leader community newspaper where the Entrant (or Community Group if relevant) is based. The Promoter reserves the right to transfer projects to the most relevant Leader newspaper. Projects that require local council approval to proceed must have received local council approval prior to submission.

Previous Grant Recipients are ineligible to apply for additional Grants for the same project in future programs.

Project Applicants can only enter in their own name. The Promoter reserves the right to request any individual entrant to produce (within the requested time) appropriate photo identification or any other documentation (to the Promoter’s satisfaction at its sole discretion) in order to confirm the entrants’ identity, age, residential address and email address, eligibility to enter the program before issuing a Grant. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the entrant’s eligibility has not been verified or validated to the Promoter’s satisfaction within the time requested, the entry will be deemed invalid. A Grant will only be awarded following any winning entrant’s validation and verification that the Promoter requires in its sole discretion.

The Promoter reserves the right to request any Community Group to produce (within the requested time) appropriate identification or any other documentation (to the Promoter’s satisfaction at its sole discretion) in order to confirm and verify the group’s eligibility to enter the program, before issuing a Grant. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the Community Group’s eligibility has not been verified or validated to the Promoter’s satisfaction within the time requested, the entry will be deemed invalid. A Grant will only be awarded following any winning group’s validation and verification that the Promoter requires in its sole discretion.

The Promoter accepts no responsibility or liability for the conduct of any Project and the relevant applicants remain solely liable for the conduct of their Projects.

The Promoter and its associated agencies and companies shall not be liable for any loss (including without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person’s negligence) in connection with using any Grant, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

The Promoter is not responsible for any technical malfunctions or problems with internet or network congestion, including any injury or damage to the Project Applicant’s, the voter’s or any other person’s computer which may affect participation in this Program or transmission or applications and votes via the internet.

 

2. REGISTRATIONS

Registration on the Website enables individuals to submit a Project Application and/or vote for projects.

The Promoter reserves the right, at its sole discretion, to disqualify any individual or group and any or all of their application(s) and/or votes deemed in the Promoter’s sole and absolute discretion to be (a) tampering or attempting to tamper with the entry or voting process or the operation of the Program or any website of the Program or a Program sponsor; (b) violating the terms and conditions of the Program (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, harass any other person or act fraudulently in any manner. The use of any automated software or other mechanical or electronic means that allows an entrant to automatically vote repeatedly is prohibited and will render all votes submitted by that entrant invalid.

During the Program Period, there is a specified time which applications can be submitted. Each Application Period is followed by a Voting Period.

The opportunity to participate in the eighth cycle in the Leader Local Grants Program begins 9.00am AEST Monday 12 June, 2017 (the first date/time you can submit a Project Application) and ends 5.00pm AEST on Friday 18 August, 2017 (the last time votes can be submitted for Projects), as specified in the table below.

SUBMITTING AN APPLICATION

To participate in the Leader Local Grants Program entrants should go to www.leaderlocalgrants.com.au and follow the directions to register to submit a Project Application or to vote for a Project.

For a project application to be eligible for consideration for voting, a Project Application must be submitted through the Website and be received by the Promoter before the end of the applicable Application Period. The Project Application must comply with these Terms and Conditions and must:

  •          include a description of the project idea including budget detail and how the project will improve the local community;
  •          describe a project that is capable of being completed within nine (9) months from the first date of funds disbursement;
  •          provide a level of detail sufficient to show each of the specific activities to be carried out by the entrant and others, if any,;
  •          prove that the principal goal(s) of the project are achievable;
  •          necessary to achieve the principal goal(s) of the project;
  •          identify that the individual submitting the Application is acting on behalf of (i) him/herself, (ii) a community group and if the latter the name and purposes of the community group must be included.

      Once the entrant has registered his/her Profile, the entrant, as the Project Applicant, will be able to save and submit an Application for a Grant, which must be in written form and may also contain a video (a maximum of one (1) minute) and/or photographs (a maximum of five (5) photographs including one (1) required photograph). A video is not required for a Project Application.

If the entrant submits any photograph(s) or a video with an Application, then the entrant must have written permission from all individuals identifiable in the photograph(s) and/or video (as determined by the Promoter). If an individual in the photograph(s) and/or video is under the age of majority in their state of residence, written permission must be from the individual’s parent or legal guardian.

The Application must also comply with the following:

  •        “YouTube Community Guidelines” set forth at www.youtube.com/t/community_guidelines and Terms of Service;
  •         be clear, in focus and audible;
  •         not be marked “private”, or “taken down” during the relevant Program;
  •          be appropriate to the theme of the Application;
  •         be the property of the entrant (Project Applicant);
  •         clearly state the objectives of the Application;
  •         a video must be less than one (1) minute in length; and
  •         photograph(s) must be less than 4MB each and greater than 360x240 pixels each. Total number of photographs cannot exceed five (5) photographs (including the one (1) required photograph in the entrant’s Profile).

      Any application that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject an application is at the Promoter’s sole discretion and no correspondence will be entered into.

As a condition of entering this Program, an entrant consents to the Promoter using the entrant’s name, likeness, image and/or voice in the event he or she is a winner and also to procure the participation and use of the relevant community group’s name (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event he or she is a winner, the entrant will participate in all reasonable promoted activities in relation to the Program as requested by the Promoter and its agents.

The Promoter collects personal information about an entrant to include the entrant in the Program and where appropriate award Grants. If the personal information requested is not provided, the entrant cannot participate in the Program. By participating in the Program and opting in on the Website, an entrant also acknowledges that a further purpose for collection of the entrant’s personal information by the Promoter is to enable the Promoter to contact the entrant with marketing materials at any time and via any medium including mail, telephone and commercial electronic messages, SMS (Short Message Service), MMS (Multimedia Messaging Service) IM (Instant Messaging) and email, or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.

By entering the Program and opting in on the Website each entrant agrees that the Promoter may use the entrant’s personal information in this manner. Entrants can also gain access to, update or correct any personal information by contacting the Promoter. All personal information will be stored at the office of the Promoter. A copy of the Privacy Policy in relation to the treatment of personal information may be obtained by clicking here, or by contacting the Promoter on 03 9875 8048 or visiting www.leadernews.com.au.  

Entrants will be notified by e-mail at the address provided in their Profile, advising them that their Project Application has been received by the Promoter. Entrants will be notified by the same email process whether their Project Application is being posted for Voting or if their Application was rejected during the judging stage. 

3. JUDGING 

Each Project Application will be assessed on four (4) key criteria and scaled from “Not Evident” to “Excellent”.

4 THE PROJECT MEETS THE TERMS AND CONDITIONS OF THE LEADER LOCAL GRANTS PROGRAM UNCLEAR, NOT SUPPLIED CLEAR CLEAR AND CONVINCING CLEAR, CONVINCING AND DISTINCTIVE

During the Judging Stage, the Promoter and/or its designated representatives will review each Application and:

a) Assess the Application against the four (4) criteria as listed above and determine if it meets the Terms and Conditions; then

b) Determine a maximum of ten (10) Finalists in each of the 26 Leader newspapers per Program Cycle to be posted for Voting.

If the Application passes the Judging Stage and meets the Terms and Conditions, it will be posted for Voting. There will be a maximum of ten (10) applications posted for voting in each of the 26 Leader newspapers.

If any group of individuals elects to collaborate on an Application, they are required to designate one (1) person/organisation as the Project Applicant and the submitter of the Application in the Program, and such person/organisation shall agree to these Terms and Conditions on behalf of the group of individuals. The Promoter is not responsible or liable for any disputes between collaborators arising under or related to the Program.

All Applications, including but not limited to, designs, ideas, concepts and communications, must be owned solely by the entrant who shall have sole liability for all third party claims relating to or regarding the content of their Application. All Applications will be reviewed for compliance with these terms and conditions before being posted to the Website for Voting. Such review does not relieve the entrant from responsibility for compliance with these Terms and Conditions. Entrants and Applications that do not comply with these Terms and Conditions or that otherwise contain prohibited or inappropriate content as determined by the Promoter, in its sole and absolute (but reasonable) discretion may be disqualified at any time including before, during or after any applicable Voting Period.

The Promoter (and/or its designated agent(s)), in its sole and absolute discretion, makes the final determination as to which entrants and Applications are accepted and are eligible to take part in this Program and be considered for inclusion in the Voting Period or be eligible to receive a Grant. From time to time during the Program, the Promoter may, in its sole and absolute discretion, choose to feature certain Applicants and Applications on the Website and/or in any one of the 26 participating community newspapers as listed below, and advertising materials.

Being featured on the Website and/or in the 26 participating community newspapers and advertising materials in no way impacts the likelihood of success of the entrant becoming an Eligible Grant Recipient in the Program nor does the inclusion of the Application on the Website and/or in the participating newspapers and advertising materials indicate that Promoter deems the Application to be a good example of an Application, nor does it indicate the Promoter’s preference for/endorsement of the Application and/or the subject matter of the Application.

During any Program Cycle, duplicate Applications for the same project idea for the same organisation or same purpose (even if submitted by unique individuals) will result in both Applications being rejected from the Website. By way of example and not by way of limitation, if two or more entrants submit an Application to clean up the same local park, this will be viewed as a duplicate idea and those Applications will be rejected. 

4. VOTING 

Each Application Period is followed by a Voting Period. Each registered user will be allowed to allocate ten (10) votes for the Application(s) they wish to vote for. The Website will monitor the number of Votes a Registered User has used during each Voting Period. A Registered User can only Vote through the Website. All Registered Users must be residents of Victoria and aged 18 years and over.

At the end of each Voting Period, the votes will be tallied by the Promoter and it is anticipated that the Promoter will award up to twenty-six (26) Grants to Applicants in each Program Cycle. Any un-used Votes allotted to any voter or Project Applicant will become void at the end of the Voting Period.

Individuals wishing to vote who have not previously registered to submit a Project Application, will first be required to register by following the directions on the Website. An individual who has registered on the Website to Vote for the Applications he or she thinks should receive Grants will be allowed up to ten (10) Votes each Voting Period.

Each Project Applicant registered in the Program will also be allowed up to ten (10) votes. A limit of one (1) registration per person/email address/name applies regardless of whether he or she is registering as a Voter or as a Project Applicant.

If the Promoter determines in its sole and absolute discretion, that any Project Applicant or voter has not complied with these Terms and Conditions in any way, for example, (i) use of proxy voting, (ii) by registering more than one (1) time on the Website and/or using multiple e-mail or dummy email addresses, (iii) offering any type of compensation or agreeing to compensate (monetarily or otherwise) any third party, in exchange for a Vote in any manner, or (iv) other fraudulent means in an attempt to cast more than the ten (10) Votes allotted then the Promoter reserves the right to cancel that voter’s or Project Applicant’s account, disqualify all his or her Votes and/or disqualify any Application that he or she has submitted and disallow any further participation by such individual in the Program. 

5. GRANTS 

During each Program Cycle, there are up to 26 Grants available to be awarded for a total of up to $26,000 in accordance with the following table:

If during any Program Cycle there is an insufficient number of Applications posted for Voting for any Grant Level, the number of Grants awarded will be reduced accordingly to the number of Applications.

Once each Voting Period has ended, the respective Project Applicants responsible for the 26 Applications (or such lesser amount of Applications which participated in the Voting Period) as have received the highest number of Votes will each be deemed an Eligible Grant Recipient. If there is a tie among the Applications after a Voting Period has ended, the Promoter (and/or its designated agent), in its sole and absolute discretion, will review the tied Applications and will break the tie based on the Application that first, in time, received the highest number of Votes during the Voting Period. 

6. ELIGIBLE GRANT RECIPIENTS AND GRANT AGREEMENTS 

All Eligible Grant Recipients will be required to enter into a binding Grant Agreement, which, among other things, will require the Eligible Grant Recipient to coordinate with the Promoter who will be solely responsible for dispensing the Grant to the Eligible Grant Recipient in accordance with the Grant Agreement and will restrict the Applicant’s use of the Grant as contemplated by the Application. No substitution of a Grant is offered, except at the sole and absolute discretion of the Promoter. The Grants are non-transferable. Grant Recipients cannot apply for additional Grants for the same project in future Leader Local Grants programs.

The Grant Agreement will be in a form as determined by the Promoter and at their sole and absolute discretion, and will require that potential Grant Recipients provide all documentation pertaining to costs and implementation of their project(s).

If an Eligible Grant Recipient is unwilling or unable to provide the Promoter with the agreed upon records, proof and other agreed upon items that they have met the milestones set forth in the Grant Agreement or if the Promoter determines that the Eligible Grant Recipient is in breach of the Grant Agreement, in its sole and absolute discretion, no further funds from the Grant will be provided to the Eligible Grant Recipient. The Promoter reserves the right to cancel any Grant Agreement and to take any further action it desires, including demanding the return of any Grant funds distributed, if the Promoter determines, in its sole discretion that the Applicant engaged in or supported any fraudulent or unsportsmanlike activity at any time during the Program or during the subsequent Grant Agreement period.

Upon completion of the Voting Period, the Eligible Grant Recipient will be notified by phone and/or email at the phone number and/or email address provided on his or her registration and will be required to complete, sign and return a Grant Agreement within ten (10) days of its receipt or Grant will be forfeited. If the Grant Agreement or any mail is returned as undeliverable without a forwarding address, then the Applicant may forfeit their Grant.

If for any reason the Program or any Program Cycle is not capable of being administered as planned, including without limitation, lack of sufficient number of Applicants and/or consumer Vote to support the continuing of the Program, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program, or for any reason the Promoter deems, in its sole and absolute discretion, that the Program is not meeting the expected goals, the Promoter reserves the right, in its sole and absolute discretion to cancel, modify or terminate the Program, any Program Cycle and any future Programs. In such an event, the Promoter shall have no liability in respect of any such cancellation, modification or termination and Project Applicants/Eligible Grant Recipients release and discharge the Promoter from any liability in respect of any loss, damage or claim arising as a consequence. 

The Promoter reserves the right, in its sole and absolute discretion, to require an Eligible Grant Recipient to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Program will not bring the Promoter into public disrepute, contempt, scandal or ridicule or reflect unfavourably on the Promoter, its agents or the Program as determined by the Promoter in its sole and absolute discretion.

  

7.TOYOTA HI-ACE VAN APPLICATION

During Cycle 8 entrants have the opportunity to apply to win a Toyota Hi-Ace Van to be used by their Community Group, in addition to the $1,000 cash grant.

The Toyota Hi-Ace Van is offered as a prize to be used by a Community Group in order to further its aims and objectives. It is not to be used for the personal benefit of any member of the Community Group.

Submitting an entry

To be eligible to win the Toyota Hi Ace entrants must:

1. Complete an application for the $1,000 Leader Community grant;

2. Tick the ‘Apply for Toyota Hi-Ace Van’ tick box on the application form and therefore agree to the following:

  • The Toyota Hi-Ace van will be used by the entrant’s corresponding community group and is required on an ongoing basis for the purposes of the community group with an aim to further their aims and objectives
  • The Toyota Hi-Ace van will not be used for the personal benefit of any entrant.
  • The entrant’s community group has a turnover of less than $2 million.
  • The entrant’s community group can manage the Toyota Hi-Ace van on an ongoing basis (eg: costs such as maintenance, registration, insurance and have a driver with a valid licence)
  • The entrant’s community group has plans for how others in the community may be able to utilise the Toyota Hi-Ace van
  • The Toyota Hi-Ace van will not be used for the personal benefit of any entrant.

3. Either

 a. win their masthead grant as per the guidelines above; or

 b. if none of the Grant Recipients tick the ‘Apply for Toyota Hi-Ace Van’ tick box on the application form (and are otherwise eligible), then finalists will be eligible to enter.

For a Project Application to be considered for entry into the Toyota Hi-Ace Van prize draw a Project Application must be submitted through the Leader Local Grants Website and be received by the Promoter before the end of the applicable Application Period. The Project Application must comply with these Terms and Conditions and the Apply for Toyota Hi-Ace Van terms and conditions.

Draw

Only those projects that have applied for and meet the Toyota Hi-Ace Van competition entry criteria specified herein and are either awarded a masthead $1,000 grant or, where none of the 26 masthead winners has applied to enter the Toyota Hi- Ace Van draw and been eligible, were one of the masthead finalists posted for voting at the end of the judging stage, will go in a random draw.

This draw will take place at Leader Community News, 1 Chapel Street, Blackburn on 11 October 2017 at 3.00pm AEST where one winner will be chosen through www.random.org and notified by telephone and email within two days of the draw. Winner will then be announced at the gala event at The Langham Melbourne on October 12, 2017, as well as in paper week commencing 23 October and online at www.leadernews.com.au/competitions .

Subject to State Regulation, an unclaimed prize draw will take place at Leader Community News, 1 Chapel Street, Blackburn on 10 January 2018 at 3.00pm AEST. The winner/s of the unclaimed prize draw will be notified by telephone or email within two days of that draw.

Prize

The prize on offer is a Toyota Hi-Ace Van valued at up to $64,000. Delivery may take up to six months from confirmation of order. Modifications available include tow bar. Toyota Hi-Ace Van may be branded with Leader, Toyota and / or Leader Local Grants logos which must remain on the vehicle for a minimum three years from receipt of the prize.

Prize is not redeemable for cash.

Prize must only be used for the purposes of the Community Group nominated by the entrant.

Prize must not be sold for a minimum three year period from the date it is collected. The prize winner must make the vehicle available for use in photo shoots on occasion/s when Leader articles about the project may be prepared, as directed by the Promoter.
